1. Who We Are

This website, estateclub.ca, is operated by the Canadian Estate Club, a subsidiary of Heritage Trust Company Inc., a British Columbia trust company regulated by the BC Financial Services Authority (BCFSA). References to "we," "us," and "our" in these Terms of Use mean Heritage Trust Company Inc., operating as the Canadian Estate Club.

By accessing or using this website, or by purchasing any of our courses, products, or memberships, you agree to these Terms of Use. If you do not agree, please do not use this website.

2. Educational Content Only, Not Professional Advice

The Canadian Estate Club provides educational content about estate planning for Canadians. This includes our website, free resources such as the Estate Planning Starter Kit, our free masterclass, the Peace of Mind Estate Planning System™ digital course, the Estate Organizer, Canadian Estate Club membership, our podcast, books, newsletters, and emails.

All of this content is general education. It is not legal, tax, financial, or accounting advice, and it is not a substitute for advice from a qualified professional who knows your personal circumstances. Estate planning laws and taxes vary by province and change over time, and the right decisions depend on your individual situation. Before acting on anything you learn from us, you should consult a qualified lawyer, notary, accountant, or financial advisor in your province.

Using this website, watching our masterclass, purchasing a course or membership, or communicating with us does not create a solicitor-client relationship, a fiduciary relationship, or any professional advisory relationship. The fiduciary and trustee services of Heritage Trust Company Inc. are separate from the Canadian Estate Club's educational offerings and are engaged only through a formal written agreement with Heritage Trust Company Inc.

3. No Guaranteed Outcomes

We are confident in the quality of our educational materials, but your results depend on your own circumstances and effort. We do not guarantee any particular legal, tax, financial, or personal outcome from using our content, completing our courses, or following our checklists and worksheets.

4. Purchases, Pricing, and Payment

Prices for our paid offerings are stated at checkout in Canadian dollars unless otherwise indicated. Applicable taxes may be added.

If you purchase using a payment plan, you are agreeing to pay all installments in the plan, not only the first payment. The full payment schedule and total price are disclosed at checkout. If an installment payment fails, we may suspend your access to the course or product until payment is brought up to date.

Payments are processed by third-party payment processors. We do not store your full payment card details.

Limited-time pricing and enrollment deadlines are genuine. When a deadline passes, the offer shown is no longer available at that price.

5. Refunds

The Peace of Mind Estate Planning System™ digital course comes with a 14-day money-back guarantee. If you are not satisfied, contact us within 14 days of your purchase and we will refund your payment in full. Refunds are returned to your original payment method.

Refund terms for other products, if any, are stated at checkout or in our Refund Policy. Where these Terms and the Refund Policy differ, the Refund Policy governs.

6. Membership

Canadian Estate Club membership is a recurring subscription billed at the rate disclosed at signup. You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. We do not provide partial-month refunds. Annual and lifetime membership options, where offered, are subject to the terms disclosed at signup.

We may change membership pricing or benefits from time to time. If we change the price of your recurring membership, we will notify you in advance, and you may cancel before the new price takes effect.

7. Your Account

Some parts of this website and our course platform require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts and course access are for one person and may not be shared. Notify us promptly if you believe your account has been accessed without authorization.

8. Licence to Use Our Materials

When you purchase a course, product, or membership, we grant you a personal, non-exclusive, non-transferable licence to access and use the materials for your own personal estate planning education. You may print or download worksheets, checklists, and fillable forms for your own use and for use within your immediate family.

You may not copy, share, resell, publish, distribute, or create derivative works from our materials, including course videos, guides, presentations, the Peace of Mind Estate Planning System™ framework and graphics, the Estate Values Map, and the Estate Organizer, without our prior written consent. You may not share your course login or provide course materials to non-purchasers.

All content on this website and in our products is protected by copyright and trademark law and is owned by or licensed to Heritage Trust Company Inc. "Peace of Mind Estate Planning System" and associated graphics are proprietary to us.

We may suspend or terminate access for violation of this licence, in addition to any other remedies available to us.

9. Acceptable Use

You agree not to use this website or our platforms to violate any law, infringe anyone's rights, upload malicious code, attempt to gain unauthorized access to our systems or other users' accounts, scrape or harvest content or data, or harass other members in community spaces. In member community spaces, we may remove content and suspend or terminate membership for conduct that is abusive, promotional without permission, or otherwise inconsistent with a respectful learning environment.

10. Communications

If you send us an unsolicited email, voicemail, or message through this website, the communication is not confidential and does not create any professional relationship. Please do not send us confidential or sensitive personal information unless we ask for it through a secure channel.

By registering for our masterclass, downloading free resources, or making a purchase, you consent to receiving related emails from us. You can unsubscribe from marketing emails at any time using the link in each email. We handle personal information in accordance with our Privacy Policy.

11. Third-Party Services and Links

Our website and programs rely on third-party platforms for functions such as course hosting, webinar delivery, payment processing, and email. Your use of those platforms may also be subject to their own terms and privacy policies.

This website may link to third-party websites for convenience. We do not endorse and are not responsible for the content, accuracy, or practices of third-party sites.

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of our website and products is limited to the amount you paid us for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under consumer protection legislation that applies to you.

14. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, your violation of law, or your infringement of any third party's rights in connection with your use of our website or materials.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia. Any dispute arising from these Terms or your use of this website will be resolved in the courts of British Columbia, sitting in Vancouver, unless applicable consumer protection law gives you the right to bring proceedings elsewhere.

We may update these Terms from time to time. Changes take effect when posted to this page, and the effective date above will be updated. Your continued use of the website or our products after changes are posted means you accept the updated Terms.
